The judicial system in this country is awash with black robed activists, posing as neutral arbiters of constitutional rights and governmental powers. The system is broken, is badly infected, and needs immediate treatment. The scales that measure the balance of power in our government are leaning toward an out of control Judiciary.
Once again, a judge has poked her nose into matters that should be left to the military under the leadership of our Commander in Chief. She has ruled, that the detainees at Guantanamo Bay in Cuba can challenge their detainment in the U.S. Courts. This is a horrible idea, for the same reasons we do not require the Commander in Chief to obtain a bench warrant prior to launching retaliatory nuclear strikes.
There is no doubt that a government run amok is no good. Who would want to live under the oppressive boot heel of a Saddam, or a Joseph Stalin? No one, of course, but that is not the danger that we face by indefinitely detaining the enemies of America and Israel. These people are not American citizens, and they are not accused of conspiring to shoplift from the 7-11 on the corner of Anystreet and Main. They are suspected of participating directly or indirectly with terrorists. They are conspirators with an enemy that desires our destruction.
The issues at stake demand harsh measures right now, least we find ourselves living under Marshall Law in the future. The people who are detained in Cuba have not earned the broad protections that our Constitution affords its citizens. For our citizens, our political system of government, and our Free Press will protect us sufficiently from excessive governmental power. I would suggest that the greater threat today, is our un-elected Judges.
